UP RERA imposes Rs 2.5 crore penalty on 11 developers who failed to comply with past orders

NEW DELHI: The Real Estate Regulatory Authority of Uttar Pradesh (UPRERA) has imposed penalty of Rs 2.5 crore against 11 developers for failing to comply with the authority’s order, which were in favour of the homebuyers.

The authority had passed these orders under Section 63 of the RERA Act which empowers RERA to impose penalties up to 5% of the cost of the project for non-compliance of its orders by the promoters.

UP RERA has imposed penalty of Rs 46 lakh against Newtech Promoters & Developers Pvt. Ltd, Rs 34 lakh against Supertech Ltd, Rs 57 lakh against the Lucknow Development Authority, Rs 30 lakh against Tulsiani Construction and Developers Pvt. Ltd and Rs 27 lakh against Antriksh Realtek Pvt. Ltd.

The authority has proposed to pass further orders of penalty against defaulting promoters over the next few weeks.

“Whereas quite a larger number of promoters are abiding by the orders of the Authority, some of the promoters have not complied with its orders,” said Rajive Kumar, Chairman UP RERA.

“The authority as per RERA Acts and rules will continue to take actions and impose heavy penalties against the errant promoters so that the promoters start complying with the orders and homebuyers can get the possession of their dream houses,” he added.

The authority has further directed these promoters to deposit the amount of penalty imposed upon them within 30 days, failing which recovery certificates will be issued against them for recovery of the amount through respective District Magistrates.

“This decision of the authority is directed towards protection of the interest of the homebuyers and to make sure that the promoters abide by the orders of the authority passed by it in discharge of its lawful functions,” said Rajesh Kumar Tyagi, Secretary UP RERA.
